AN ORDINANCE AMENDING ORDINANCE NO. 01-819, THE ZONING ORDINANCE OF THE CITY OF GRANBURY, TEXAS, BY GRANTING A SPECIFIC USE PERMIT FOR CERTAIN PROPERTY IN THE CITY OF GRANBURY; REVISING THE OFFICIAL ZONING MAP IN ACCORDANCE THEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. SECTION 1. Ordinance No. 01-819, as amended, is hereby amended by granting a Specific Use Permit (SUP) on the property located on an approximate 0.23 acre portion of land described as Lot 5, Block B of the S.W. Parkway Industrial Park Addition, located at 106 Pirate Drive, within the City of Granbury, Hood County, Texas, and located within the Heavy Commercial 'HC' zoned district. The Specific Use Permit (SUP) shall be issued to allow for the operation of a Major Auto Repair business, as defined in the City of Granbury Zoning Ordinance Article 12 and the following conditions: 1. The Specific Use Permit shall automatically expire 3 years from City Council approval (expires Sept. 5, 2020). For the term of the SUP, use and development of the property must be in compliance with the approved site plan attached hereto as Exhibit A,· 2. The property shall not be used for the storage of wrecked vehicles or the dismantling of vehicles or the storage of vehicle parts; and 3. All vehicles being stored for repair shall be screened from all public rights-of-­way. [shall be located inside the building off-hours, or screening shall be provided by the applicant for outside storage] SECTION 6. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. The City Secretary of the City of Granbury is hereby directed to publish in the official newspaper of the City of Granbury, the caption, Section 1, penalty clause, publication clause and effective date clause of this Ordinance one time as required by Section 2 .13 of the Charter of the City of Granbury EFFECTIVE DATE These ordinances shall become effective from and after its passage. PASSED AND APPROVED on this 5th day of September, 2017. These ordinances are on file in the Office of the City Secretary, 116 W Bridge St and can be seen in its entirety Monday through Friday from 8:00 AM to 5:00 PM.
